Terms and conditions for using Speqs

About these terms

These terms govern your use of the Speqs platform, operated by Speqs AB (org.nr 559546-0162), Hallandsgatan 50A, 118 57 Stockholm, Sweden. By creating an account or using our services, you agree to these terms.

1. Service description

Speqs is a platform for AI-powered user testing and simulation of digital products. The platform allows you to upload designs and prototypes, configure AI-driven simulations of user behavior, and analyze the results.

2. Your account

When you create an account:

  • You must provide accurate and current information
  • You are responsible for maintaining the security of your account
  • You must not share your account credentials with others
  • You must notify us promptly of any unauthorized use of your account

3. Subscription and billing

  • Speqs operates on a credit-based system. Pricing is as displayed on the platform
  • Payments are processed by Stripe. You agree to Stripe's terms when making a purchase
  • Credits are non-refundable unless required by applicable law
  • We may change pricing with at least 30 days notice. Existing purchased credits remain valid

4. Customer data

You retain all rights to the data you upload to Speqs, including designs, prototypes, and simulation configurations. We process your data solely to provide the service as described in our privacy policy.

You are responsible for ensuring you have the necessary rights to any content you upload. You must not upload content that infringes on the intellectual property or privacy rights of others.

5. AI-generated content

Simulation results and analyses are generated by AI and provided for informational purposes. While we strive for useful and realistic simulations:

  • Results are not guaranteed to accurately predict real user behavior
  • AI-generated content should inform, not replace, user research decisions
  • You may use simulation results for your internal business purposes

6. Acceptable use

When using Speqs, you agree not to:

  • Upload content you don't have rights to use
  • Use the platform for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract our AI models or algorithms
  • Circumvent usage limits, credit systems, or access controls
  • Use automated systems to access our services without permission
  • Interfere with or disrupt the platform or its infrastructure

7. Intellectual property

The Speqs platform, including its technology, AI models, software, design, and content, is owned by Speqs AB or our licensors. You may not reproduce, distribute, or create derivative works from our platform without written permission. You retain ownership of your data as described in Section 4.

8. Service availability

We aim to maintain high availability of our platform but do not guarantee uninterrupted access. Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the fullest extent permitted by law:

  • Speqs's total liability to you is limited to the amount you have paid us in the 12 months preceding the claim
  • Speqs is not liable for any indirect, incidental, special, consequential, or punitive damages
  • These limitations apply regardless of the legal theory on which the claim is based

10. Termination

Either party may terminate at any time. Upon termination:

  • Your access to the platform will be revoked
  • Your data will be retained for 30 days, then deleted
  • You may request an export of your data before termination
  • Billing records are retained as required by law

We reserve the right to suspend or terminate accounts that violate these terms.

11. Changes to terms

We may update these terms as our service evolves. For material changes, we will notify registered users by email at least 30 days in advance. Continued use of the platform after the effective date constitutes acceptance of the new terms.

12. Governing law

These terms are governed by Swedish law and applicable European Union regulations. Any disputes arising from these terms shall be resolved by the courts of Stockholm, Sweden. If you are a consumer in the EU, you also benefit from any mandatory provisions of consumer protection law in your country of residence.
